CIVIL COURY CIRCULAR NO. 21 SUBJECT:- MEMORANDA OF APPEAL AND APPLICATION FOR REVISION

The present practice is that ase of appeals or revisions, a petition is filed by the advocate for the appellant or the applicant declaring an intention to appeal or apply for revision against the decree or order of the Court below, adding that the grounds for the appeal or application would be submitted later or later after perusal of the proceedings .
In most cases the grounds are not submitted except after many month , and so the decision of the cases are, inevitably unreasonably, delayed.
I wish to point out that this practice is wrong has to come to an end . According to order XI, rules 1 and 2 of C.J.O. an appeal must be made by a memorandum , setting forth concisely under distinct heads the grounds of objections and that such a memorandum must be presented and the prescribed fees paid within the period of one month from the date of the decree or order appealed against . In future no appeal shall be accepted unless a memorandum stating the ground of the appeal is submitted within the said prescribed period. So is the case with applications for revision . According to order XII, rule 1.the application must be made in the form of petition , stating the grounds of the revision ,within 15 days from the date of the decree or order applied against . In future no application for revision shall be accepted unless the grounds for revision are submitted within the said prescribed period .
Three instruction shall apply to all cases deciced by Court in Khartoum Circuit . but in cases deciced in other circuits .when sufficient reason is shown an extension of time ,such as is reasonably necessary for the submission of the memorandum of appeal or the grounds for revision . may be granted , but once and not more than once.
